Algemene voorwaarden – Valiente Aceite de Olivas
1. Identiteit van de ondernemer
Valiente Aceite de Olivas is een handelsnaam van Valits, gevestigd in Nederland.

2. Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op elk aanbod en elke overeenkomst die via de webshop van Valiente tot stand komt. Door het plaatsen van een bestelling verklaart de consument zich akkoord met deze voorwaarden.
3. Aanbod en productinformatie
Valiente streeft naar een zo nauwkeurig mogelijke weergave van producten en informatie. Kennelijke fouten of vergissingen, waaronder prijs- of typefouten, binden Valiente niet.
Onze olijfolie is een natuurproduct. Variaties in smaak, geur, kleur en intensiteit zijn inherent aan oogst, klimaat en productiemethode en vormen geen grond voor klachten of retour.
4. Totstandkoming van de overeenkomst
De overeenkomst komt tot stand op het moment dat:
– de consument een bestelling plaatst; en
– Valiente de bestelling bevestigt per e-mail.
Valiente behoudt zich het recht voor om bestellingen te weigeren of aanvullende informatie op te vragen.
5. Prijzen en betaling
Alle vermelde prijzen zijn inclusief btw en exclusief verzendkosten, tenzij anders vermeld.
Betaling dient te geschieden via de aangeboden betaalmethoden.
Bestellingen worden pas verzonden na volledige ontvangst van betaling.
Valiente behoudt zich het recht voor om prijzen te allen tijde aan te passen.
6. Levering
Levering vindt plaats op het door de consument opgegeven adres.
Opgegeven levertijden zijn indicatief en vormen geen bindende termijn. Aan deze termijnen kunnen geen rechten worden ontleend.
Het risico van beschadiging of verlies gaat over op het moment van levering.
Valiente levert in Nederland en kan, naar eigen inzicht, levering binnen de Europese Unie aanbieden.
7. Herroepingsrecht (Consumenten)
De consument heeft het recht de overeenkomst binnen 14 dagen na ontvangst zonder opgave van redenen te ontbinden.
Om gebruik te maken van het herroepingsrecht dient de consument Valiente binnen deze termijn schriftelijk of per e-mail te informeren.
Geretourneerde producten dienen: ongeopend, ongebruikt, onbeschadigd en in originele verpakking te worden teruggestuurd.
De kosten voor retourzending zijn voor rekening van de consument.
8. Uitsluiting herroepingsrecht
Het herroepingsrecht is uitgesloten voor:
- verzegelde producten die om hygiënische of gezondheidsredenen niet geschikt zijn om te worden teruggezonden en waarvan de verzegeling is verbroken;
- producten met een beperkte houdbaarheid;
- geopende voedingsmiddelen, waaronder olijfolie.
9. Klachten en conformiteit
De consument is verplicht geleverde producten onmiddellijk na ontvangst te controleren.
Klachten dienen binnen een redelijke termijn na ontdekking, doch uiterlijk binnen 14 dagen, schriftelijk te worden gemeld.
Producten dienen te voldoen aan de redelijke verwachtingen zoals die voortvloeien uit de overeenkomst. De wettelijke conformiteitsregels zijn van toepassing.
10. Aansprakelijkheid
De aansprakelijkheid van Valiente is beperkt tot het bedrag van de aankoopprijs van het betreffende product.
Valiente is niet aansprakelijk voor:
- indirecte schade
- gevolgschade
- gederfde winst
- schade voortvloeiend uit onjuist gebruik
Voor zover wettelijk toegestaan, is iedere verdere aansprakelijkheid uitgesloten.
11. Overmacht
Valiente is niet gehouden tot het nakomen van verplichtingen indien sprake is van overmacht, waaronder begrepen maar niet beperkt tot:
- transportproblemen
- storingen in toeleveringsketens
- overheidsmaatregelen
- stakingen
12. Intellectueel eigendom
Alle rechten met betrekking tot de website, merknaam, logo’s, teksten en afbeeldingen berusten bij Valiente.
Zonder voorafgaande schriftelijke toestemming is het niet toegestaan om content te reproduceren, verspreiden of commercieel te gebruiken.
13. Privacy
Valiente verwerkt persoonsgegevens in overeenstemming met de geldende privacywetgeving (AVG).

14. Toepasselijk recht en geschillen
Op alle overeenkomsten is Nederlands recht van toepassing.
Geschillen worden voorgelegd aan de bevoegde rechter in Nederland.
15. Wijzigingen
Valiente behoudt zich het recht voor deze algemene voorwaarden te wijzigen.
De meest actuele versie is te allen tijde beschikbaar op de website.

Valiente strives to ensure that all product information is accurate and complete.
Obvious errors or mistakes are not binding.
Our olive oil is a natural product. Variations in taste, aroma, color and intensity may occur due to harvest and production conditions and do not constitute grounds for claims or returns.
4. Conclusion of Agreement
The agreement is concluded when:
– the customer places an order; and
– Valiente confirms the order via email.
Valiente reserves the right to refuse orders
5. Prices and Payment
All prices are inclusive of VAT and exclusive of shipping costs unless stated otherwise.
Orders will only be dispatched after full payment has been received.
6. Delivery
Delivery is made to the address provided by the customer.
Delivery times are indicative and do not constitute binding deadlines.
Risk transfers to the customer upon delivery.
Valiente primarily delivers within the Netherlands and may offer delivery within the European Union.
7. Right of Withdrawal
Consumers have the right to withdraw from the agreement within 14 days of receiving the product.
Returned products must be: unopened, unused, undamaged and in original packaging
Return shipping costs are borne by the customer.
8. Exclusion of Withdrawal
The right of withdrawal does not apply to:
- sealed goods which are not suitable for return due to health protection or hygiene reasons once unsealed;
- perishable goods;
- opened food products, including olive oil.
9. Complaints and Warranty
Customers must inspect products upon receipt.
Complaints must be reported within a reasonable time.
Products must conform to reasonable expectations under the agreement.
10. Liability
The liability of Valiente shall be limited to the purchase price of the product concerned.
Valiente shall not be liable for:
- indirect damages;
- consequential damages;
- loss of profit;
- damages resulting from improper use of the product.

Valiente shall not be liable for any failure or delay in the performance of its obligations if such failure or delay is due to circumstances beyond its reasonable control (force majeure).
Force majeure shall include, but is not limited to:
- transport disruptions or delays;
- interruptions or failures in supply chains;
- governmental measures or regulations;
- strikes, labor disputes or industrial actions;
- pandemics or other public health emergencies;
- failures of third-party service providers.
In the event of force majeure, Valiente shall be entitled to suspend its obligations for the duration of the force majeure situation, or to terminate the agreement in whole or in part, without being liable for any damages.
12. Intellectual Property
All intellectual property rights relating to the website, including but not limited to trademarks, trade names, logos, texts, images, product descriptions and other materials, are the exclusive property of Valiente or its licensors.
It is strictly prohibited to reproduce, distribute, publish, modify, or otherwise use any content from the website without prior written consent from Valiente. Any unauthorized use of the intellectual property rights of Valiente may result in legal action.
13. Privacy
Valiente processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).
Personal data is used solely for the processing and fulfillment of orders, communication with customers, and compliance with legal obligations.
Personal data may be shared with third parties only where necessary for the performance of the agreement or where required by law.
